In other news, the three-judge panel that last month blocked construction on the St. Clair dedicated right-of-way project has removed itself from the case after finding an “appearance of bias” on the part of Justice Ted Matlow.
The City had filed a motion to set aside the earlier ruling on the grounds that Matlow had become publicly involved in a battle with City Hall.
As a result of the panel’s latest decision, a new set of judges will hear the case. However, the Globe and Mail reports that under no circumstances will construction begin before spring.
To this date, the original panel has never released an explanation for their original injuction against the project.
